This discussion question is informed by the following EPAS Standards: 2: Engage Diversity and Difference in Practice 5: Engage in Policy Practice First Answer1 .The federal government plays a large role in regulating mental health services. One federal policy that is extremely helpful is the Mental Health Parity and Addiction Equity Act (MHPAEA) (MHA, 2023). This policy makes sure that insurance companies provide the same benefits to mental health and substance use disorder (SUD) as they do for physical health conditions. In addition, the benefit limits set by insurance companies must be as favorable for treatment of mental health and SUD as for medical and surgical treatments. The pros to this policy are that those treated for mental health or addiction disorders have access to the same resources as those with a physical health condition. This recognizes that mental illness can be just as debilitating as a physical illness and alleviates the financial constraints for individuals who are trying to overcome mental health issues or substance use disorders. The obvious con to this policy is a probable increase of premiums from insurance companies. A few factors that influenced the development and implementation of the MHPAEA policy was the unequal benefits from insurance companies regarding mental health and SUD, an increased awareness and personal experiences with mental health and addiction, and a push by Congress to improve policies for victims of mental health (Barry et al., 2010). The Americans with Disabilities Act (ADA) did away with discrimination based on an individual’s disability (ADA, 2023). It has allowed people to have equal access to employment, resources, and services. It redefined disability to include the physically and mentally impaired. It opened avenues for parents to get better assistance for their disabled children in school and work. It actually gave individuals with disabilities a level playing field for life. There are several differences between drug treatment and drug enforcement. Drug treatment sees drug addiction as a treatable disease (Mattson, 2017). Drug enforcement views it as a choice that is made by an individual. Treatment focuses on helping an individual recover from a substance use disorder (SUD). Drug enforcement focuses on protecting others from someone who chooses to abuse drugs. As someone who has seen government programs that deal with both treatment and enforcement, my personal opinion is that drug treatment has a higher success rate. I believe SUD is an illness that often begins by self-medicating due to poor mental health. Once the addiction sets in, many people become trapped in a lifestyle that they never would have chosen. Second Answer 2. Federal health policy implementation offers benefits such as standardization, increased healthcare coverage, public health promotion, research, innovation, and stakeholder collaboration. However, it also faces regulatory requirements, political influence, implementation challenges, affordability concerns, and potential inefficiencies. Centralized decision-making in federal health policy can lead to inefficiencies and bureaucratic delays. Power and influence in health care extend beyond interest groups, electoral politics, and party politics (Kreidler, 2021). The Americans with Disabilities Act (ADA) of 1990 prohibits discrimination against individuals with disabilities in various areas, including employment, public accommodations, transportation, telecommunications, and government services. It ensures equal opportunities and access by requiring employers to provide reasonable accommodations, making public spaces and services accessible, and mandating accessible transportation and telecommunication services. Drug treatment addresses substance abuse by providing support and recovery through therapeutic interventions, counseling, and medical assistance. Drug enforcement focuses on law enforcement efforts to control and prevent illicit substance production and distribution. Successful addiction treatment requires support, knowledge, and accessibility to evidence-based interventions. Third Answer 3. The Patient Protection and Affordable Care Act (ACA) signed into law by then President Barack Obama on March 23, 2010, was instituted primarily to assist more people obtain affordable health insurance coverage by expanding the eligibility criteria for Medicaid, incentivizing companies through tax benefits and relief to offer comprehensive health insurance, and by supporting and rewarding innovation in medicine designed to decrease the costs of health care (Jansson, 2020). Proponents of the ACA tout the millions of people who were able to acquire health care coverage due to the expanded coverage options at a cost palatable to low-income earners or folks with no income, including a significant number of young adults who prior to the ACA did not purchase health insurance (Jansson, 2020). That access combined with the mandate prohibiting insurance providers from employing polices to increase pricing or decrease the quality and availability of care, made the ACA very attractive to people seeking health care coverage (Jansson, 2020). Other benefits included the constraint on denial of coverage due to a person’s chronic or pre-existing condition, and the reduction in the cost of much needed prescription medication (Jansson, 2020). Opponents of the ACA focus on the rise in the cost of insurance to those who were already insured, an increase that seemed unavoidable, given the expansion of coverage by insurance providers (Jansson, 2020). Other objections included the imposition of an initial fine for failure to become insured, a practice since discontinued, as well as the implementation of several taxes to subsidize the ACA (Jansson, 2020) (US Department of Health and Human Services, 2023). Dissenters have also highlighted the elimination of jobs or reduction of work hours by corporations feeling the burden of providing health care coverage to employees (US Department of Health and Human Services, 2023). At the time the ACA was enacted a vast number of younger people did not have health insurance mainly due to the out of reach costs, a phenomenon more prevalent in already marginalized communities of poor people and immigrants (Jansson, 2020). Further, the existing federal programs, Medicare and Medicaid were facing mounting criticism for only covering severe medical conditions and for compelling recipients to divest ownership of valuable assets as a condition of eligibility (Jansson, 2020). Politicians like then future President Obama were cognizant of the demand for health insurance as well as the exorbitant strain on the country’s economy by an overburdened medical care system and understood the necessity of installing a viable option to ease that stress on the country (Jansson, 2020). The American with Disabilities Act of 1990, as amended, was enacted by the United States Congress to provide a transparent understanding to the entire nation that persons with disabilities, as defined within the law, would no longer be denied the right to fully participate in all aspects of society because of their physical or mental disability (US Department of Justice Civil Rights Division, 2023). Persons with disabilities have historically faced discrimination in obtaining suitable living conditions, in seeking fair employment that provides reasonable accommodation, in accessing public services, and in pursuing higher education (Jansson, 2020). Additionally, unlike protections against discrimination based on protected classes like race, age, sex and national origin, persons with disabilities have not had available legal recourses (Jansson, 2020). In its twenty-three-year existence, the ADA has significantly improved the lives of people with disabilities by fundamentally restoring their sense of pride, value and worth (US Department of Justice Civil Rights Division, 2023). People with physical disabilities now have access to stores, restaurants, schools and other places of leisure and business without trepidation (US Department of Justice Civil Rights Division, 2023). People with mental disabilities are supported in their right to request and receive reasonable accommodations without the fear of stigmatization or worse, dismissal from places of learning and employment (US Department of Justice Civil Rights Division, 2023). People whose life and lifestyle choices are different from others no longer have to worry about being mislabeled as disabled and consequently denied and discriminated against (US Department of Justice Civil Rights Division, 2023). Drug treatment addresses the abuse of illicit substances in a manner conducive to helping the user or addict stop consumption through a myriad of approaches including medication, therapy, outpatient and admitted management programs, and peer support (Jansson, 2020). Enforcement focuses more on incarceration as a deterrent to the use of drugs by promulgating what constitutes an illegal drug and what penalties and punishment are attached to the failure to adhere to the prohibitions of possession, sale and/or use (Jansson, 2020). Treatment is arguably the more effective and thus preferable solution to the abuse of illicit drugs for a variety of reasons, including the humanity inherent to acknowledging and combating substance abuse and the retention of dignity and liberty while fighting to get past drug misuse, under the umbrella of controlled management of the disease of drug abuse, as opposed to an involuntary and more often than not, abrupt halt to contact with drugs in the potentially hostile, dangerous and unpredictable environment of prison without adequate and proper medical and therapeutic support (Jansson, 2020).
